1. You acknowledge that there are certain risks associated with conveying
instructions by electronic mediums, and hereby fully waive, discharge and
indemnify VETIVA CAPITAL MANAGEMENT LIMITED in respect of any
loss or damages resulting from the use of mobile phones or the internet to
access any of its services.
2. Where confirmation of a transaction is transmitted to you through an
electronic medium, VETIVA will not be liable to you or to any other person
receiving the confirmation for or in respect of any direct, indirect or
consequential liability, loss, damage or cost of any kind or nature resulting
from the use of mobile phones or instructions sent through an electronic
medium, whether or not as a result of the destruction of data, system
malfunction, interruption of communication links or any other problem over
which VETIVA has no control.
3. We reserve the right to record any telephone and electronic exchange
between yourself and any member of our staff and you acknowledge that
this is an international practice and is used solely for the purpose of
resolving any disputes which may arise concerning telephone advice or
internet instructions.
